4. Subscription and Payments

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEXIRENT.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless FlexiRent.ai and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

13. Termination

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period.

13.2 Termination by Us

We may suspend or terminate your account immediately if you violate these Terms, fail to pay fees, or engage in conduct that we determine is harmful to the Service or other users.

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. You may request export of Your Data within 30 days of termination. After this period, we may delete Your Data.

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.

16. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and FlexiRent.ai regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights to any successor in interest.
